By booking a session or using our services, you agree to these terms. Please read them before submitting a booking inquiry or retainer. If you have questions about anything here, reach out before booking.

About these terms

These Terms and Conditions ("Terms") govern your use of the services provided by S Five Vision Media, LLC ("S Five Vision Media," "we," "us," or "our"), including photography sessions, digital gallery delivery, and use of our website at sfivevisionmedia.com.

By booking a session, submitting a retainer, or using our website, you ("Client," "you," or "your") agree to be bound by these Terms. If you are booking on behalf of a minor, you represent that you are the minor's parent or legal guardian and that you accept these Terms on their behalf.

These Terms are supplemental to any separate client contract or booking agreement you sign with S Five Vision Media. In the event of a conflict between these Terms and a signed client contract, the signed client contract will govern. Where your signed contract is silent on a matter, these Terms apply. Together, these Terms and your booking confirmation and/or signed contract constitute the full agreement between you and S Five Vision Media.

Our services

S Five Vision Media offers professional photography services including, but not limited to:

  • Senior portrait sessions (individual packages and The Legacy Package)
  • Athlete branding and sports photography
  • Team media days for school and club programs
  • Entrepreneur and personal branding photography
  • Mini sessions (Headshot, Cap & Gown, and seasonal themed events)
  • The Legacy Team ambassador program

All services are subject to availability and are offered at the rates published on our website at the time of booking. We reserve the right to update our packages, pricing, and service offerings at any time. Changes will not affect bookings already confirmed and retainer paid.

Add-on services (such as custom albums, priority editing, or extra locations) are available at the time of booking or during your planning call. Add-ons must be confirmed and paid before the session date.

Booking & Retainer

A session date is not confirmed or held until a retainer has been received. Reaching out, completing a contact form, or having a planning call does not constitute a booking.

Retainer amount: A non-refundable retainer is required to secure your session date. The retainer amount will be communicated to you at the time of booking. The remaining balance is due on or before the day of your session unless a payment plan has been arranged in advance.

Non-refundable: Retainers are non-refundable under all circumstances, including cancellation by the client. The retainer compensates us for holding your date, turning away other potential clients, and the planning time invested before your session.

Booking confirmation: You will receive a written booking confirmation by email once your retainer is processed. Please review this confirmation carefully and contact us immediately if any details are incorrect.

 

Important: Do not make non-refundable travel or styling arrangements (hair, makeup, etc.) before receiving your written booking confirmation.

Payment

Payments are processed through third-party payment tools. We do not collect or store payment card information directly. By submitting payment, you also agree to the terms of the applicable payment processor.

Balance due: The remaining balance after the retainer is due in full on or before your session date. Sessions will not proceed until the balance is paid unless a written payment plan has been confirmed in advance.

Payment plans: We offer payment plans on a case-by-case basis. If you would like to arrange a payment plan, please discuss this with us before booking. Payment plan terms will be confirmed in writing as part of your booking.

Late payment: If a balance is not received by the session date and no payment plan has been arranged, we reserve the right to cancel the session. In such cases, the retainer will not be refunded.

Pricing: All prices are listed in U.S. dollars and are exclusive of applicable taxes unless otherwise stated. Tax will be calculated and disclosed at the time of payment.

Cancellation & rescheduling

Cancellation by the client: If you cancel your session for any reason, your retainer is forfeited. If the full balance has been paid at the time of cancellation, the retainer portion is non-refundable and the remaining balance may be refunded at our discretion depending on timing and circumstances.

Rescheduling by the client: We understand that life happens. Each client may reschedule their session once at no charge, subject to availability. To use your complimentary reschedule, please notify us as early as possible and no later than 48 hours before your original session date. Your retainer will transfer to the new date.

If you request a second reschedule, or if you notify us with less than 48 hours' notice, the original retainer will be forfeited and a new retainer will be required to secure the new date. We will always do our best to work with you given the circumstances.

Cancellation by S Five Vision Media: In the rare event that we must cancel your session due to illness, emergency, or circumstances beyond our control, we will notify you as quickly as possible and work with you to reschedule at no additional cost. If rescheduling is not possible, your retainer will be refunded in full. This is the limit of our liability in such cases.

 

Weather cancellations are handled separately — see Section 6.

Weather & unforeseen circumstances

Outdoor sessions are subject to weather conditions. We monitor the forecast in the days leading up to your session and will communicate with you in advance if conditions are a concern.

Weather rescheduling: If weather conditions are severe enough to significantly affect image quality or safety (such as thunderstorms, heavy rain, or extreme cold), we will offer a complimentary reschedule at no charge to either party. Overcast skies, light cloud cover, or mild wind are generally not grounds for rescheduling and often produce excellent results.

The final decision on whether conditions warrant a reschedule rests with S Five Vision Media. We will always prioritize your safety and the quality of your images.

Client-initiated weather cancellations: If you choose to cancel or not attend a session due to weather that we have not determined to be a safety or quality concern, standard cancellation terms apply and the retainer may be forfeited.

Force majeure: Neither party will be held liable for failure to perform obligations due to events beyond reasonable control, including but not limited to natural disasters, public health emergencies, government-mandated restrictions, or acts of God. In such cases, we will work together in good faith to reschedule.

Image rights & licensing

Copyright ownership: All photographs created by S Five Vision Media remain the intellectual property of S Five Vision Media, LLC. Copyright is retained by S Five Vision Media regardless of who is the subject of the images or who paid for the session.

Client license — personal use: Upon full payment of your session, you are granted a non-exclusive, non-transferable license to use your delivered images for personal, non-commercial purposes. This includes printing for personal use, sharing on personal social media, and sending to family and friends.

Commercial use license: If you intend to use your images for commercial purposes — including advertising, business marketing materials, product promotion, or any use that generates revenue — a commercial use license is required. Branding and entrepreneur photography packages include a commercial use license. For other session types, please inquire about commercial licensing before your session.

Prohibited uses: You may not sell, sublicense, or transfer your images to any third party. You may not submit images to stock photography sites or use them in ways that imply endorsement of a product or service without a commercial license. You may not alter, crop, or manipulate the images in ways that materially misrepresent them or damage our professional reputation.

Credit: When sharing images on social media, we appreciate (but do not require) a tag or credit to @sfivevisionmedia. It helps small businesses and means a lot.

 

Printing: Your print release allows you to print images at any professional print lab of your choice. We recommend professional labs for best quality results. S Five Vision Media is not responsible for the quality of prints made by third-party vendors.

Portfolio & marketing use

S Five Vision Media reserves the right to use images from your session for portfolio, marketing, and promotional purposes, including on our website, social media platforms, and printed marketing materials, unless you have submitted a written opt-out request prior to or at the time of your session.

Opt-out: If you do not wish for your images to be used in our portfolio or marketing, please notify us in writing before your session. We will fully honor that request. Opting out does not affect the quality of your session or any other terms.

Minors: We handle images of minors with particular care. We will not identify minor clients by full name on public platforms. If a parent or guardian requests removal of a minor's images from our public portfolio at any time, we will honor that request promptly. See Section 10 for additional terms related to minors.

Removal after publication: If you would like images removed from our public platforms after they have been published, please contact us at sfivevisionmedia@gmail.com and we will remove them within a reasonable timeframe. Note that images previously shared on social media may have been saved or shared by others beyond our control.

Minors & parental consent

Many of our clients are minors, including high school seniors and student athletes. We take our responsibility to minor clients seriously.

Parental or guardian consent: For clients under 18 years of age, a parent or legal guardian must authorize the booking. By submitting a retainer or booking confirmation for a minor, you represent that you are the minor's parent or legal guardian and that you consent to the session on their behalf and accept these Terms.

Presence at sessions: A parent or guardian is welcome to attend any session involving a minor. We do not require parental presence but encourage it for younger clients. If a parent chooses not to attend, we ask that they remain reachable by phone throughout the session.

Image use: Additional care is taken with the public use of images featuring minors. We will not publish a minor's full name alongside their images on public platforms, and we will honor any parental request to remove images promptly and without question.

Legacy Team: Participation in The Legacy Team ambassador program by a minor requires parental acknowledgment and consent. Parents who have concerns about the program are encouraged to contact us before their child applies.

Client conduct

We are committed to creating a fun, comfortable, and professional experience for every client. In return, we ask that clients:

  • Arrive on time and prepared for their session as discussed during the planning call
  • Communicate openly and honestly about expectations, concerns, or changes before the session day
  • Treat our team with respect throughout the session and all communications
  • Respect the locations we shoot at — including leaving no trace, following posted rules, and not accessing restricted areas
  • Notify us as early as possible of any changes to the session plan, including number of outfit changes, locations, or additional participants

S Five Vision Media reserves the right to end a session early or decline future bookings from clients who engage in disrespectful, threatening, or disruptive behavior toward our team or at our shooting locations. In such cases, the retainer and any payments made will not be refunded.

Limitation of liability

Equipment failure: In the unlikely event of equipment failure, data corruption, or other technical issues that result in the loss of session images, our liability is limited to a refund of payments made for that session (excluding any third-party costs already incurred). We take multiple precautions to prevent data loss, including dual-card recording where available and immediate backup procedures after each session.

No guarantee of specific results: Photography is a creative service. While we bring our full skill, experience, and care to every session, we cannot guarantee specific outcomes, expressions, poses, or lighting conditions. We do not offer refunds based on subjective dissatisfaction with images that were delivered in accordance with the package specifications and our published editing style.

Third-party services: We are not liable for the performance, terms, or failures of third-party services we use or recommend, including Pixieset, Calendly, payment processors, or print labs. Your use of these services is governed by their own terms.

Maximum liability: To the fullest extent permitted by applicable law, S Five Vision Media's total liability to you for any claim arising from or related to our services shall not exceed the total amount you paid for the specific session giving rise to the claim.

Disclaimer: Our services are provided "as is." We disclaim all warranties, express or implied, to the maximum extent permitted by law.

Website use

The content on sfivevisionmedia.com — including all text, photographs, graphics, and design — is owned by or licensed to S Five Vision Media, LLC and is protected by copyright law. You may not reproduce, distribute, or use our website content for commercial purposes without our written permission.

You may view, share links to, and reference our website content for personal and non-commercial purposes, provided you give appropriate credit to S Five Vision Media.

We make reasonable efforts to ensure the accuracy of information on our website, but we make no warranties about the completeness, accuracy, or reliability of any content. Pricing, availability, and package details are subject to change. Always confirm current details directly with us before booking.

Links to third-party websites are provided for convenience only. We are not responsible for the content, privacy practices, or terms of any third-party sites.

Governing law

These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions.

Any dispute arising from or related to these Terms or our services that cannot be resolved through direct communication will be subject to the exclusive jurisdiction of the state and federal courts located in Jefferson County, Wisconsin. You consent to personal jurisdiction in those courts.

We genuinely hope any disagreements can be resolved by simply talking to us. If you have a concern at any stage — before, during, or after your session — please reach out directly. We are a small, owner-operated studio and we take every client relationship personally.

Changes to these terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes will be communicated to active clients where reasonably practicable.

The Terms in effect at the time you submit your retainer are the Terms that govern your booking. Subsequent changes to these Terms will not retroactively affect confirmed bookings.

Your continued use of our website or services after updated Terms are posted constitutes acceptance of those changes for any future bookings.
